MY LITTLE PARTY– TERMS OF TRADE FOR GOODS PURCHASED

Please read our Terms and Conditions carefully before you start to use our website, as these will apply to your use of our website and any arrangement we enter into with you for any good or services.

All prices are stated in New Zealand dollars (NZD).

My Little Party reserves the right to amend any prices at any time without notice.

Once your order and payment has been received and cleared by My Little Party your goods will be dispatched to you within 24-48 hours. Full payment must be received and cleared within 5 days of your order being placed (unless otherwise agreed prior to your order being placed with My Little Party) or your order will be cancelled.

My Little Party methods of payment are credit card via Pay Pal.

Please choose carefully, My Little Party does not offer refunds if you change your mind.

My Little Party uses courier companies with in New Zealand, and they will deliver your package to your door within 1-4 working days from the time of dispatch (Please note this may be longer for rural deliveries, or busy periods eg. Christmas). My Little Party will send your package within 24-48 hours. If you require something urgently please contact us and this could be arranged.

All packages are sent by a New Zealand courier company to a New Zealand physical addresses only. We are unable to send to PO Box or Private Bag numbers. You can also collect your goods from us by prior arrangement with My Little Party.

Please note deliveries will only take place on weekdays (Monday to Friday) There are no deliveries on Saturday, Sunday or Public Holidays.

My Little Party endeavours to carefully pack your package to ensure it arrives in the same condition they left our premises in. If any of your items arrive damaged please contact us immediately when receiving your package. Please ensure all packaging is retained, as we will contact the New Zealand courier company and arrange compensation or replacement products for you as soon as possible. Please note we will request photographic evidence to provide to our courier that the Package has been Damaged.

My Little Party are not responsible for loss or damage to packages that have happened in transit or that are delivered to an incorrect address.

My Little Party is not responsible for the steps you take to ensure that the process that you employ for accessing our website, and does not expose you to the risk of viruses or other forms of interference, which may damage your computer system. We do not accept responsibility for any interference or damage to your computer system arising out of or relating to your use of our website or any hot linked site associated with My Little Party.

My Little Party will collect and retain information about its customers to:

  1. Advise customers of new products or services
  2. Statistically analyse customer site usage and products purchased
  3. To improve content and products offered on My Little Party website and
  4. To improve customer ease and satisfaction

This information is held on our database and is not made available to any other party. Under the Privacy Act 1993 you have the right to access any personal information held about you and correct or delete such information if required. You can do this by emailing us at leanne@mylittleparty.co.nz

MY LITTLE PARTY– TERMS OF TRADE FOR HIRED PIECES

Please read our Terms and Conditions carefully before you start to use our website, as these will apply to your use of our website and any arrangement we enter into with you for any good or services.

Definitions
The “Hirer” refers to the person or business hiring equipment from My Little Party
The “Equipment” means all and any equipment that belongs to or is hired from My Little Party

Terms and Conditions of Hire Pieces/Equipment

The equipment will remain the property of My Little Party at all times.

Where the Hirer is more than one person liability shall be joint and/or several. The person signing the documents for and on behalf of the Hirer hereby agrees with My Little Party that he or she has the authority of the Hirer to make this agreement on the Hirer's behalf and is empowered by the Hirer to bind the Hirer to this agreements and hereby indemnifies My Little Party against all losses and cost incurred by My Little Party arising out of the person signing this agreement failing to have such power and/or authority.

Any item for hired from My Little Party is for private and personal use only and must not be used in a commercial situation unless agreed with My Little Party prior to hireage.

The Hirer shall not sublet the equipment to any other person or business.

All prices are in New Zealand Dollars (NZD).

All Hire charges must be paid before hireage begins, for the period of hire requested by the Hirer.

My Little Party methods of payment for hire equipment are a credit card payment via Paypal.

My Little Party reserves the right to amend any prices at any time without notice.

Once your order and payment has been received and cleared by My Little Party your goods will be ready for collection from My Little Party base location, or for delivery. All hire charges must be paid before hireage begins, for the period of hire requested.

The price stipulated for the hire equipment is for one use only and for the noted hired period.

If the Hirer, for any reason terminates a booked hire, then the following fees will apply:
(a) If cancelled within 48 hours of hire commencement date – 25% of total invoice value will not be refunded
(b) In any circumstances where cancellation occurs and My Little Party has incurred additional costs such as loading of vehicles, transportation of equipment, or utilization of labour, then additional fees may also be incurred by the Hirer.

It is the responsibility of the Hirer to check all parts are present prior to hiring any equipment from My Little Party and that the equipment hired from My Little Party is fit and appropriate for private and personal use.

The Hirer must notify My Little Party immediately if any equipment is lost or damaged upon collection. The Hirer will take care of the equipment and will be solely responsible and shall pay for the loss or damage of any equipment of hire during the hire period.
Theft of an item from My Little Party will require a Police report to be submitted by the Hirer to My Little Party, and will incur an additional charge or replacement costs at the hirers expense.

The Hirer acknowledges that he or she has received adequate instruction on the correct use of the Equipment, which includes demonstration, verbal or written instructions.

The Hirer will ensure that any child/children using the equipment are properly supervised at all times by their parent’s, caregiver’s or guardian’s, it is the responsibility of  the hirer to ensure that the furniture is used correctly and to ensure that no child is injured whilst using the equipment and will indemnify My Little Party accordingly. In no event will My Little Party be held responsible for any damage, loss or injury caused by or arising out of the use of any equipment supplied.

The Hirer shall on no account attempt to repair the Equipment of My Little Party, and shall notify My Little Party immediately in case of breakdown or failure during the hire period.

Should you wish to extend your hire period beyond the agreed date of return you must notify My Little Party as soon as possible, as late returns will incur an additional charge of a late fee. This late fee will be the cost of a normal daily hire.

Please ensure all equipment is clean, complete and undamaged in any way upon return. Any equipment, returned dirty, or damaged in any way, could incur an additional charge or replacement costs at the hirers expense.

The Hirer agrees to provide My Little Party with Credit Card details which will be charged should any of the following take place:
(1) Any equipment is returned damaged beyond what is expected with normal use. The Hirer's Credit Card will be charged for cleaning and/or repair costs, or the full retail value of the equipment.
(2) The equipment is not returned (or made available for pickup) by the time indicated on the invoice, unless it has been agreed to extend the hiring period between the Hirer and My Little Party. The full retail value will then be charged to the Hirer’s Credit Card.

My Little Party’s count and/or decision as to condition of the Equipment prior to dispatch and upon return shall be final.

If the Hirer does not have a Credit Card or does not pay fees, My Little Party will have the right to use a Debt Collection Agency to collect all outstanding cost/s as per the above, including the Debt Collection charges.

If the Hirer is in breach of any of the terms of this agreement, then My Little Party may terminate the hire and/or repossess any of the equipment without prior notice to the Hire.

My Little Party may terminate the hire at any time without providing any reason for so doing, either verbally or in writing.  My Little Party will not be responsible to the Hirer for any loss they may claim to have suffered in respect of such termination.

The Hirer is responsible for the insurance of Equipment for the period of hire including where the hirer transports to and from the premises or pick up point of My Little Party. The Hirer shall indemnify My Little Party against any damage or loss or from theft which may occur whilst the equipment is in the care of the Hirer. If a situation arises that legal fees or any expenses involved in the collection of these charges will be payable by the Hirer.

Once a hired booking has been received and payment has cleared by My Little Party, the Hirer acknowledges and agrees to the My Little Party’s Terms and Conditions. If for any reason the Hirer has not acknowledged these terms and conditions, by signing the hire agreement, and/or by accepting the Equipment for hire from My Little Party the Hirer will have deemed to have accepted the terms and conditions for hire.

My Little Party makes no warranty or representations to the state, quality, or fitness of any equipment owned by My Little Party for any particular purpose and no such warranty shall be implied from the description of the equipment on the face of the form. All implied warranties and conditions as to the state, quality or fitness of the equipment for any purpose are hereby excluded.

My Little Party is not responsible for the steps you take to ensure that the process that you employ for accessing our website, and does not expose you to the risk of viruses or other forms of interference, which may damage your computer system. We do not accept responsibility for any interference or damage to your computer system arising out of or relating to your use of our website or any hot linked site associated with My Little Party.

My Little Party may revise their Terms and Conditions at any time, any part of them, or add further Terms and Conditions at their discretion, at any time by amending this page or any relevant document settings out any part of their Terms and Conditions.
